Section 1 – Booking and scheduling a kitesurfing holiday
1.1 – Bookings are only confirmed once a payment has been made and a confirmation email sent. Bookings cannot be reserved without payment.
1.1.1 – Bookings can only be secured with a 50% non-refundable deposit.
1.1.2 – Final payments must be completed 31 days before the holiday commences.
1.2 – When the Traveller books a kitesurfing holiday with The Kitesurf Centre, they are selecting a bundle of tuition to be included with the accommodation offered at a specific destination with a specific start and end date. A clear listing of “included services” is provided in the holiday information brochure. “Excluded services” and “optional extras” are not limited to those listed, but do provide examples where extra charges for services outside of the “included services” list may apply.
1.3 – The Traveller is responsible for booking their own flights to and from the destination country. The Kitesurf Centre will provide details of the nearest airport and pickup time of the airport to accommodation transfer listed in the included services. It is the responsibility of the Traveller to book flights matching the allocated transfer time to utilise this included service. Transfers arranged at a different time to the transfer provided by The Kitesurf Centre are at the Travellers own expense.
1.4 – Travellers are required to notify The Kitesurf Centre at the time of booking the holiday of any medical condition suffered by them that may be relevant to the activity, and which could be considered a risk to their own or others health and safety. All information given will be treated with strict confidentiality. Any misinformation will void the partakers insurance cover for which The Kitesurf Centre will not be held accountable.
1.5 – Travellers are responsible for ensuring that they meet the requirements to enter the country of the kitesurfing holiday destination and any through-routes. Disadvantages resulting from non-compliance with these regulations, e.g., payment of cancellation costs, shall be borne by the Traveller. The Kitesurf Centre advises that the Traveller ensures that they hold a valid passport with at least 6 months validity from the date of entry to the destination country.
1.6 – Travellers are responsible for ensuring that they hold the correct tourist visa for entry to the destination country. Disadvantages resulting from non-compliance with these regulations, e.g., payment of cancellation costs, shall be borne by the Traveller. The Kitesurf Centre recommends following guidance from the embassy or consulate of your home country to meet the requirements necessary to enter the destination country.
Section 2 – Rescheduling & Cancellations
2.1 – If the Traveller is unhappy with The Kitesurf Centre’s terms and conditions of booking, they can contact The Kitesurf Centre and request a refund within 48 hours of the booking confirmation, provided that they have booked onto the holiday prior to 31 days of the holiday start date. Within 31 days of the holiday, refunds will not be given. Bookings cancelled within the 48 hour period following the transaction will incur a 3% fee to cover costs incurred by The Kitesurf Centre while processing the transaction.
2.1.1 – Any cancellations after this 48 hour window are not refundable, however, the Traveller may transfer their holiday to another person.
2.2 – The Traveller may cancel the booking at any time up to 31 days prior to the holiday start date (September 10th 2024) by contacting The Kitesurf Centre.
2.2.1 – Cancellations initiated before August 10th 2024 will be refunded minus the 50% non-refundable deposit.
2.2.2 – Cancellations will not be accepted on or after August 10th 2024 and the holiday is not refundable if the Traveller cannot attend.
2.3 – If the traveller does not make use of individual travel services that The Kitesurf Centre has properly offered for reasons for which the Traveller is responsible, the traveler has no right to a proportional refund of the travel price. The same applies if a service cannot be used because the Traveller does not meet certain requirements (e.g., health or conditional requirements), although The Kitesurf Centre has fulfilled its pre-contractual information obligations in this regard. The Kitesurf Centre recommends taking out travel cancellation insurance.
Section 3 – Provision of coaching services
3.1 – All decisions regarding the running or cancellation of any kitesurf tuition are at the absolute discretion of The Kitesurf Centre whose decision shall be final.
3.2 – All courses are weather dependent and this may adversely affect your course. If in the judgement of The Kitesurf Centre a course is unable to start, or has to stop early due to weather conditions or for any reason where safety could be compromised, a lesson credit will be provided in respect of any time owed to the Traveller by The Kitesurf Centre; a refund will not be an option.
3.2.1 – All lesson credits should be used within the holiday period as scheduled by The Kitesurf Centre Team. Where a 3 hour group session cannot be completed during the holiday period due to the weather, The Kitesurf Centre will raise a voucher worth £119 which must be used before October 31st 2024 within The Kitesurf Centre School’s UK services.
3.3 – The Kitesurf Centre’s course outlines are just a guide and it has to be accepted that everyone progresses at different rates. Along with possible changing weather conditions, unique rates of progression may have an effect on the course structure. It is down to The Kitesurf Centre’s staff to make the decision on any given day how the course is run which will always have the groups / individuals best interests taken into consideration. No courses guarantee a level of attainment. We work towards these in accordance with Travellers abilities and individual learning styles.
3.4 – Travellers must be aware that power kite sports are potentially dangerous and are undertaken entirely at the Traveller’s own risk.
3.5 – Any Traveller using their own equipment on a lesson must hold their own 3rd party liability insurance. This may be purchased via the British Kite Sports Association as a part of their membership scheme.
3.6 – The Kitesurf Centre reserve the right to use any photos taken during the lessons (excepting minors, whose photos shall not be taken.) The images will not be sold onto a 3rd party. If you feel uncomfortable with a photo being taken on your lesson, please advise your instructor.
3.7- If the Traveller does not make use of the coaching services that The Kitesurf Centre has properly offered for reasons for which the Traveller is responsible, the Traveller has no right to a proportional refund of the travel price. The same applies if a service cannot be used because the Traveller does not meet certain requirements (e.g., health or conditional requirements).
3.8 – If a Traveller leaves the lesson while the instructor deems the conditions fit to run the course, the student forfeits their lesson time and no refund will be given. If a Traveller cancels on the day or does not show up, they are charged in full for that session.
3.9 -Travellers who book a coaching program offered by The Kitesurf Centre must have the required experience as described in the invitation to participate. The responsible instructor or supervisor on site has the right, in the event of a lack of qualification, to rebook the Traveller to a course suitable for his/her knowledge, provided that such a course or program can be offered; if such a course or program cannot be offered, there is no claim to participation in the booked course.
Section 4 – Conditions of Occupancy
4.1 – Rooms must not be used for any unlawful purpose. The Traveller will be liable for payment of any charges incurred by any guest with the room together with all replacements and necessary costs for any damage or loss to the accommodation and its contents caused by any guest. The Traveller authorises the accommodation manager to charge their credit card for any loss, damage or monetary contribution for which any Traveller is liable under this document or otherwise.
Section 5 – Limitation of liability
5.1 – The Kitesurf Centre is not liable for service disruptions, personal injury and property damage in connection with services that are provided by a third party agency and not provided by The Kitesurf Centre (e.g., excursions and accommodation).
5.2 – The Kitesurf Centre is not liable for services that are used by the Traveller as part of the package tour and are not arranged or organised by The Kitesurf Centre or its local representatives, but rather, for example, by the accommodation provider or other persons or companies under their own responsibility.
5.3 – The Kitesurf Centre is not liable for loss of services due to travel disruptions, COVID-19, personal illness or injury or the improper provision of services in any area that The Kitesurf Centre does not directly control.
